Should I sign the other driver’s car insurance HIPAA release and give a recorded statement?

Don’t sign anything and don’t agree to a recorded statement.  Under Virginia insurance law, you are not required to do anything immediately after an accident.   Instead, click here to learn more about your rights.


Is there a deadline to make my injury claim?

Under Virginia law, you typically have a two (2) year statute of limitations for car accident claims.  Sometimes, there is a shorter timeframe (for example if you have a claim against a Virginia County).  So, do not sit on your rights.

They are claiming that I’m partially at fault for the crash. What now?

Virginia is one of only three states that apply Contributory Negligence.  This rule says that if the defendant is 99% at fault, but you’re just 1% at fault, you lose.  This is an unforgiving rule, which the court will apply without regard to the seriousness of your injuries.
